KNOW ALL MEN, That Maurice Walton, of said county, and state, hereingafter called "Obligor", is held and bound unto Jno A Sims hereinafter called "Obligee" his heirs and assigns, in the penal sum of Four thousand dollars, for the payment of the Obligor binds himself, his heirs, and legal representatives by these presents. The condition of the foregoing obligation is such that , WHEREAS, Obligor has this day agreed to sell to Obligee and Obligee has agreed to buy, from Obligor, the lot of land hereinafter described, at and for the price of Two thousand dollars of which Obligee has this day made and delivered to Obligor, his promisary notes, payable as follows: Note for Nineteen hundred and seventy five dollars ($1,975) due one year from date without interes, and twenty-five dollars in cash. WHEREAS, Obligee agrees that when any improvements are built upon said lots that said improvements shall consist of a residence, all taxes that may be laid on said premises including all governmental and municipal charges that may become liens thereon, before they become delinquent. Now, if said Obligee shall well and truly pay said note at the time specified, and pay all taxes and charges as aforesaid, then Obligor binds himself, his heirs, executors and administrators to make and deliver to Obligee, of his assigns, good and sufficient titles in fee simple with general warranty, to and for, All, that lot of land situated in the Village of Summerville int he said Richmond County, Georgia, on the north side of Williams Street between Hall and Ketherine Streets having a frontage on Williams Street of eighty feet, more or less, and running north of two hundred feet of equal width, and bounded as follows: Description of the boundaries refer to a plat made by John D. Twiggs, Civil Engineer, on March 24th, 1905, and recorded in Book XXXXXXn280. Bounded north by Lot No. 11, east by Lot No. 1,west by Lot No. 3 all of said plat and south by Williams Street. This lot originally had a frontage on Williams Street of one hundred feet, twenty feet of the eastern partion having been sold to Mr. Tatum, owner of Lot No. 1 of said plat. But, on failure of Obligee to pay the said note or to keep or perform his agreements as aforesaid or any of them then his obligation shall be void. It is further agreed that if default be made in the payment of said note at the time specified or in the payment of said taxes or other charges as aforesaid then in any one of said event all of the above indebtedness then unpaid shall become immediately due and payable at the option of Obligor, and in addition to the remedies provided by law, Obligor, or his legal representatives, or assigns, are authorized and empowered to sell said property in bulk or in parcels, in their discretion, at public outcry, to the highest budder for cash, at the door of the Court House of said county after first advertising the sale once a week for four calender weeks in any newspaper published in said county, and to make to the purchaser or purchasers, thereof, good and sufficient titles in fee to the same thereby divesting out of Obligee all right and equity he may have therein, and vesting the same in the purchasers aforesaid. Obligor his representatives or assigns, are made Attorneys in Fact for Obligee, to make said conveyances, and recite therein the default, adverising for sale, and such recitals shall be conclusive on Obligee. The proceeds of sale shall be applied, first to the cost and expense thereof, next to the payment of said indebtedness and interest, and balance if any, shall be paid to Obligee. And, at said sale, Obligor, or his representitives, or assigns may bid and purchase. IN WITNESS WHEREOF, Obligor and Obligee have hereunto set hands and seals this 1st day of August, 1910.
